The Failure of the 28-Point Ceasefire Plan for Ukraine: How Diplomatic Efforts Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency triggered by the introduction of a new comprehensive peace framework for resolving the conflict appeared – temporarily – to have been stabilised. A American diplomat spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, the Kremlin made its retaliation: a renewed assault of rocket attacks on Kyiv.

The Rhythm of Negotiation and Warfare

The succession of conflicting incidents captured the bleak nature of the current period. By day, political struggles are fought: positive announcements are issued from various governments. Immense energy is allocated on containing particular approaches. By night, Russian leadership forcefully demonstrates the world that, for them, war remains the key method for achieving "settlement".

Nighttime Reality

As Russia's attack unfolded into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was revealed. Ukraine is able to track rocket firings from enemy soil, a capability enabled by timely intelligence. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to engage hostile aerial threats roared overhead – sophisticated military planes provided to Ukraine by Western partners.

Shortly after, Kyiv's anti-aircraft weapons thundered: multiple launches targeted at a hostile projectile. This was a modern interception technology at work, most likely supplied through Western nations. Every firing shakes the surroundings, rattling buildings. The brief panic quickly gives way to sober acceptance: maybe the incoming missile won't cause damage this time, sparing the city from catastrophe and further power outages.

Persistent Threats

Soon after, a heavy machine gun opened up on a unmanned aircraft in the vicinity, part of a rapid response unit – most likely allied-provided weaponry. Sadly, the shots failed to hit the enemy aircraft – it continued its flight toward its objective.

Intermittently, this persisted until dawn. Kyiv greeted the daybreak reports: multiple fatalities, devastation and utility failures in many homes as a result of the night's assault. As customarily, everyone still continued their routines – enduring hostilities. But those 24 hours illustrated Ukraine's essential dependence on external assistance – a need that regional partners are evidently unprepared to substitute in the near term.

Unsuccessful Negotiations

The detailed framework from Washington provoked deep reactions, controversy and deep concern – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and bilateral conferences.

Every new proposal from American administration follows the identical sequence: a diplomatic cavalry charge against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They contain the crisis but never actually secure success. This pattern will, certainly, continue.

Tactical Assessments

It is tempting to accuse particular leaders of consistently pushing Russian terms. But that does not seem to be the entire situation. US administration works based on a principle understood by international relations experts: you cannot win at the negotiating table what you have failed to defend militarily. The US administration assumes that it is unrealistic to compel Moscow to relinquish the territory that it presently holds in Ukraine's occupied territories.

The issue is that while recognising this factual reality, American administration does little to discourage Russia, through words or deeds, from thinking that the current condition will not evolve additionally in its benefit in the coming year.

Divergent Views

Therefore, Russian leadership is confident that the clock favors them – that Ukraine and its supporters are nearing depletion. Their reason to accept conditions that does not give them the largest achievable advantage is almost completely absent. There may be numerous efforts to end hostilities, but they will continue as long as Russia's government remains highly assured in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, slowly losing lives and land but avoiding a entire defensive failure until circumstances change in its benefit.

Current Realities

Objectively, there are no real preconditions for a armistice. Now, subjective factors are becoming relevant: political desires to broker a ceasefire and achieve global acclaim, and the government's dual difficulties – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the country's interests against any plan Kyiv finds unsuitable, so that their priority does not move to internal issues. And although their mission will now be considerably more difficult after current events, it remains highly unlikely that this will change their overall approach.

These opposing factors are guiding negotiations.

Conclusion and Outlook

It took a just a single week to eliminate the 28 points of the most recent proposal. Assertive and inconsistent approach of the matter by Washington, opposition by Ukraine and the other European countries, along with soothing efforts of representatives, and finally, recent disclosures, all achieved their purpose.

While new plans based on established approaches are forthcoming, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are based on Russian demands and show particular unwillingness to alter the situation, if they remain united and enhance their military capacity at a much faster pace. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the coming months, mainly require ongoing international assistance.
